Provider Agreement

This Provider Agreement is a supplement to the Terms of Service and governs your relationship with Anixiv as an independent contractor. You must accept both documents before offering services on the platform. Operated by COM Consulting Group, LLC d/b/a Anixiv.

1.Independent Contractor Status

You are not an employee of Anixiv. Your relationship with COM Consulting Group, LLC d/b/a Anixiv is that of an independent contractor. Nothing in this Agreement or the Terms of Service creates an employment relationship, partnership, joint venture, or agency relationship between you and Anixiv.

As an independent contractor:

  • You control how, when, and where you perform services. Anixiv does not supervise, direct, or control the manner in which you perform beauty services.
  • You set your own prices and terms for services. Anixiv does not set, suggest, or control your pricing.
  • You are free to work on other platforms and maintain your own independent client base simultaneously with your use of Anixiv.
  • You choose which service requests to bid on. Anixiv does not assign work to you.
  • You provide your own tools, equipment, products, and supplies. Anixiv does not supply materials for your services.
  • You may hire subcontractors or assistants at your own discretion and expense.
  • You may decline any service request at any time before acceptance without penalty. Standard cancellation terms apply after you have accepted a booking.

Anixiv may provide you with training on how to use the Anixiv platform. This training relates solely to platform functionality and does not constitute training on how to perform beauty services, nor does it establish an employment relationship.

2.Licensing and Compliance

  • You represent that you hold all licenses, certifications, and permits required by applicable law to perform the services you offer through Anixiv, including all requirements of the Arizona Barbering and Cosmetology Board and any other applicable state or local licensing authority.
  • You agree to promptly update your credentials on the platform if your licensing status changes, expires, or is revoked.
  • You understand that Anixiv verifies credentials during onboarding but does not guarantee their ongoing validity. Anixiv may re-verify credentials at any time.
  • You are solely responsible for compliance with all applicable federal, state, and local laws, including health and safety regulations, sanitation standards, and professional licensing requirements.
  • If your license expires and you continue to offer services through Anixiv without updating your credentials, your account may be automatically suspended until valid credentials are provided.
  • Providing services without required licensing may result in legal consequences for you and is grounds for immediate and permanent removal from the platform.

3.Insurance

  • You acknowledge that Anixiv does not provide professional liability insurance, general liability insurance, or any other insurance coverage for services you perform through the platform.
  • You are strongly encouraged to carry professional liability insurance appropriate for the services you offer. The absence of insurance coverage does not limit your liability to clients or third parties.
  • You accept full responsibility for any claims, injuries, damages, property damage, or losses arising from your services, products, techniques, or negligence.
  • In the event of a service-related injury or damage claim, Anixiv will provide your business contact information to the affected client and may document the incident for its own records, but assumes no financial responsibility beyond any applicable platform goodwill refund.

4.Tax Responsibilities

  • As an independent contractor, you are responsible for all federal, state, and local taxes on income earned through Anixiv, including self-employment tax, income tax, and any applicable Arizona Transaction Privilege Tax.
  • Anixiv does not withhold taxes from your payouts. You are responsible for making estimated tax payments if required.
  • Anixiv will issue IRS Form 1099-K or 1099-NEC as required by law for payments exceeding applicable IRS thresholds. Stripe (Anixiv's payment processor) collects your tax identification information and handles 1099 filing on Anixiv's behalf. You can access your tax documents through your Stripe Express dashboard.
  • Anixiv does not collect, store, or retain your Social Security Number, EIN, or other tax identification numbers. All sensitive tax information is handled exclusively by Stripe.
  • You are responsible for keeping accurate records of your income and business expenses for tax purposes. You should consult a tax professional for advice specific to your situation.

5.Platform Fee and Payment Terms

  • Anixiv charges a platform fee of 10% on marketplace bookings (service requests posted by clients who find you through the platform). This fee is deducted from your payout before disbursement.
  • Direct client bookings through the "My Clients" feature (clients you have imported or had a prior relationship with) are not subject to the platform fee. Standard Stripe processing fees (~2.9% + $0.30) still apply.
  • Standard payouts are processed daily and arrive the next business day at no additional cost.
  • Express payouts are available for a 2% fee and arrive within minutes to your connected bank account or debit card.
  • Tips from clients are processed separately and paid to you in full (100%). Anixiv does not take any portion of tips.
  • Payouts may be held for admin review in certain circumstances, including new provider status, unusually large amounts, disputed bookings, or active account review. Anixiv will notify you of any payout holds.

6.Off-Platform Payment Prohibition

All payments for bookings made through Anixiv must be processed through the platform. This policy protects both you and your clients.

  • Accepting or soliciting off-platform payments (including cash, Venmo, Zelle, PayPal, CashApp, or any other method) for Anixiv bookings violates this Agreement and the Terms of Service.
  • First confirmed violation: written warning issued to your account.
  • Second violation within 6 months: 30-day suspension from the platform.
  • Third violation: permanent removal from the platform.
  • Providers who maintain an on-platform payment rate below 95% may lose tier advancement eligibility, chargeback protection, and access to the My Clients feature.
  • If a client requests to pay off-platform, you must decline and direct them to complete payment through Anixiv. You may report clients who solicit off-platform payments to support@anixiv.com.

7.Chargeback Protection

Anixiv provides tier-based chargeback protection as a benefit to providers in good standing:

  • New Pro tier: You are responsible for chargeback losses. Anixiv will assist you with gathering evidence and submitting a dispute response to the card network.
  • Established tier: Anixiv covers 50% of verified chargeback losses from the platform's chargeback reserve fund. You are responsible for the remaining 50%, which may be deducted from future payouts.
  • Top Rated tier: Anixiv covers 100% of verified chargeback losses from the platform's chargeback reserve fund.

Chargeback protection requires maintaining good standing: an on-platform payment rate of 95% or higher and a chargeback rate below 3%. This protection is a benefit provided by Anixiv, not a guarantee. Anixiv reserves the right to modify or discontinue chargeback protection at any time with reasonable notice to Providers. Chargeback protection does not apply to chargebacks that result from your fraud, misrepresentation, or failure to perform services as agreed.

8.Non-Solicitation

Anixiv invests in connecting you with new clients. To protect this marketplace:

  • You agree not to solicit Anixiv clients (clients who found you through the Anixiv platform) for off-platform bookings for a period of 12 months following your last interaction with that client through Anixiv.
  • This non-solicitation provision applies to active outreach (messages, calls, social media contact initiated by you) encouraging clients to book outside Anixiv. It does not prohibit a client from independently choosing to contact you through other means.
  • Clients who were your existing clients before they appeared on Anixiv (imported through My Clients or who you had a documented prior relationship with before joining the platform) are not subject to this non-solicitation provision. Your existing client relationships remain yours.
  • Violation of this non-solicitation provision may result in account suspension and a circumvention fee equal to 20% of the estimated annual value of the off-platform relationship.

This provision protects the marketplace that connects you with new clients and does not restrict your ability to serve clients who find you through other channels.

9.Content License

  • You grant Anixiv a non-exclusive, royalty-free, worldwide license to display your portfolio photos, bio, service descriptions, and client reviews on the Anixiv platform and in Anixiv marketing materials (including social media, advertising, and promotional content).
  • You retain full ownership of all content you create and upload to the platform.
  • You may remove your content at any time by deleting it from your profile settings. Account deletion removes your content from active display, though it may remain in backups and archived data per our Privacy Policy.
  • You represent that you own all rights to any content you upload and that it does not infringe any third-party intellectual property rights.

10.Termination

  • Either party may terminate this Agreement at any time.
  • You may delete your account through account settings. A 30-day grace period applies before permanent deletion.
  • Anixiv may suspend or terminate your account immediately for violations of this Agreement or the Terms of Service, fraudulent activity, excessive chargebacks, failure to maintain required licensing, or behavior harmful to clients or the platform.
  • Upon termination, outstanding payouts for services you have already completed will still be processed and disbursed on schedule.
  • Active bookings at the time of termination will be cancelled per the Cancellation Policy. Clients will be notified and refunded as applicable.
  • The non-solicitation provision in Section 8 survives termination of this Agreement for 12 months from your last active booking on the platform.

11.Dispute Resolution

  • Disputes between you and Anixiv will be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), conducted in Maricopa County, Arizona.
  • You waive the right to participate in class action lawsuits or class-wide arbitration against Anixiv.
  • Small claims court exception: either party may bring eligible claims in small claims court without first going through arbitration.
  • Governing law: State of Arizona.
